What Is Guardianship?
Guardianship of an adult is a court process that determines if an individual is unable to care for themselves responsibly or fully understand how their decisions could endanger their health or safety.
Based on evidence, a judge decides if an adult would be best served under guardianship and appoints a Guardian to advocate on their behalf.

A Guardian is an advocate who exercises utmost care and diligence They focus on determining the least restrictive options, guarding freedoms and preserving dignity by:
* Protecting and Promoting Self-Reliance.
* Guarding Autonomy and Independence.
* Encouraging the person to participate in decisions to the maximum extent of their abilities. -
What Is A Nationally Certified Guardian?
Several members of the Guardian and Protective Services team are Nationally Certified Guardians and proud members of the National Guardianship Association. As Certified Guardians, we adhere to nationally recognized standards, ensuring the highest levels of integrity and competence in our service. Achieving certification involves passing the Center for Guardianship Certification exam and maintaining a clean background check. We are committed to serving our clients with dedication and compassion, continually enhancing our skills through annual continuing education.

What Are The Responsibilities Of A Guardian?
A Guardian takes the time to understand a person's history of decision-making and to best represent their desires in all circumstances.
The Court determines the areas where the Guardian can exercise decision-making or guide with supportive decision-making. The degree of authority is determined by the Court and ranges from full authority to none. The general areas of decision-making include: Place of Residence; Long Term Care Facility, if necessary; Mental Health Facility, if necessary; Vocation; Legal Matters; Financial Matters; Medical Treatment; Involuntary Treatment; Education and Training; Control and Disposition of Safety Deposit Box.

How Do Individuals Receive Help From GaPS?
A variety of agencies refer individuals to GaPS including hospitals and nursing homes, North Dakota Adult Protective Services, Human Service Centers, social services, and other entities. GaPS often serves as a safety net for at-risk individuals who may need assistance but are unable to get the help they need on their own.

What Do Services Cost?
Individuals are charged according to their ability to pay and the services required. Funding for low-income individuals is secured through public funding, tax deductible donations and grants.
Many community services are available at no cost to individuals in need and can often save the individual money. GaPS helps individuals access these services.
If an individual does not fall within the financial guidelines there are charges depending on the services provided. We can provide you with a Fee Schedule.
